Terms of Service
These terms are the agreement between you and us for the use of SurgeLab. By creating an account, or by using the service, you accept them.
Who we are
SurgeLab is operated by SurgeLab AI Ltd, company number 17297397, registered at 81 Fernhead Road, First Floor, London, United Kingdom, W9 3EA. In these terms "we", "us" and "our" mean SurgeLab AI Ltd, and "you" means the person or business with a SurgeLab account.

The service
SurgeLab is a subscription platform that measures how AI assistants and search engines find and describe your business, generates marketing content for the brands you set up, and schedules that content to accounts you connect.
We provide the service on a reasonable skill and care basis. We do not guarantee any particular commercial result, ranking, score, level of traffic, or level of sales.
Your account
You must be at least 18 and acting for a business. You are responsible for keeping your login details secure, and for everything done through your account.
You must give accurate information when you sign up and keep it up to date. If you set up an account on behalf of a business, you confirm you are authorised to accept these terms for it.
Subscriptions and payment
Subscriptions are sold on the plan and billing period you choose at checkout, either monthly or annually. Payments are handled by Stripe. Prices are shown exclusive of VAT, which is added where it applies.
Your subscription renews automatically at the end of each billing period, at the price then in effect, until you cancel. By subscribing you authorise us to charge your payment method for each renewal.
Some features use metered add-ons, such as video generation. Where an add-on applies, the charge is shown to you before you use it.
If a payment fails we may retry it, and we may suspend your access until payment succeeds.
Free trials and promotions
Where we offer a free trial, the trial converts into a paid subscription at the end of the trial period unless you cancel before it ends. Promotional prices apply only for the period stated, after which the standard price applies.
Cancelling and refunds
You can cancel at any time from the billing page inside SurgeLab. Your subscription then runs to the end of the period you have already paid for, and does not renew.
We do not refund part-periods. If something has gone wrong, email support@surgelab.co and we will look at it.
Because SurgeLab is supplied to businesses, the consumer cancellation rights that apply to purchases by individuals do not apply here.
Price changes
We may change our prices. We will give you at least 30 days' notice by email before a change affects your subscription. If you do not accept the new price you can cancel before it takes effect.
Your content
You keep ownership of everything you give us: your brand information, logos, photographs, product details and any other material you upload.
You grant us the licence we need to host, process and display that material, and to send it to the providers listed in our privacy policy, purely so we can run the service for you. That licence ends when you delete the material or close your account.
You confirm you own or are licensed to use everything you upload, and that using it will not infringe anyone else's rights.
Content we generate
SurgeLab generates copy, images and video for your brand. As between you and us, you own the output generated for your brand, and you can use it commercially.
AI output can be wrong, and it can resemble output generated for someone else. You are responsible for reviewing anything before it is published, and for making sure it is accurate, lawful, and appropriate for your business and your industry. We are not responsible for content you approve and publish.
Accounts you connect
Where you connect a third-party account, such as Google, Metricool or a social platform, you must comply with that provider's own terms. Those services are outside our control. We are not responsible for their availability, their decisions, or any action they take against your account.
You can disconnect any connected account at any time from inside SurgeLab.
Acceptable use
You must not use SurgeLab to:
- break the law, or infringe anyone else's rights.
- create or publish content that is misleading, defamatory, hateful, obscene, or that impersonates someone else.
- generate fake reviews, or content designed to deceive customers or search engines.
- upload malicious code, or try to gain unauthorised access to the service or to anyone else's data.
- resell or white-label the service without our written agreement.
- scrape, copy, or reverse engineer the platform, or use it to build a competing product.
Availability and support
We aim to keep SurgeLab available, but we do not promise it will be uninterrupted or error free. We may carry out maintenance, and we may change or withdraw features.
Support is by email at support@surgelab.co. We aim to reply within one working day.
Our intellectual property
The SurgeLab platform, its software, its prompts and workflows, its scoring method, its branding and its documentation belong to us. Nothing in these terms transfers any of that to you. You get a non-exclusive, non-transferable right to use the service while your subscription is active.
Suspension and termination
We may suspend or close your account if you break these terms, if payment fails, or if we are required to by law. Where it is reasonable to do so, we will tell you first and give you a chance to put it right.
You can close your account at any time. On closure your right to use the service ends, and we handle your data as set out in our privacy policy.
Liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
Subject to that, we are not liable for loss of profit, loss of business, loss of goodwill, loss of anticipated savings, or any indirect or consequential loss.
Subject to that, our total liability to you in any twelve month period is limited to the amount you paid us in the twelve months before the claim arose.
We are not liable for any failure caused by something outside our reasonable control, including the failure of a third-party service the platform depends on.
Data protection
How we handle personal information is set out in our privacy policy, which forms part of these terms. Each of us will comply with UK data protection law.
Changes to these terms
We may update these terms. We will update the date at the top, and where a change is significant we will tell you by email before it takes effect. Continuing to use the service after that means you accept the new terms.
General
These terms are the whole agreement between us about the service. If any part of them is found to be unenforceable, the rest continues to apply. If we do not enforce a right straight away, that does not mean we have given it up. You may not transfer your rights under these terms without our agreement. Nobody other than you and us has any right to enforce these terms.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
